最新修订的民事诉讼法及司法解释增加的公益诉讼制度给环境公益诉讼提供了法律依据,为环境公益诉讼提供了诉讼途径。但现行的由原告完全预付诉讼费用并承担败诉的诉讼费用的规定,显然不利于提高公众提起环境公益诉讼的积极性。本文从我国现行的《诉讼费用交纳办法》和环境公益诉讼案件的特点着手,以经济学、社会学两个不同的视角进行分析论证,采用比较分析法对比发达国家并结合我国社会实情,建议由国家财政支出环境公益诉讼费用并建立公益基金,以完善环境公益诉讼制度,充分发挥环境公益诉讼制度作用,守护碧海蓝天。
The newly revised Civil Procedure Law and the judicial system of public interest litigation added to provide a legal basis for environmental public interest litigation, litigation for environmental public interest litigation. However, the existing provisions that the plaintiffs fully prepay the litigation expenses and bear the legal costs of losing the case apparently are not conducive to raising the public’s enthusiasm for bringing environmental public interest litigation. This article starts from the current “litigation fee payment method” and the environmental public interest litigation cases in our country, analyzes and argues from two different perspectives of economics and sociology, compares the developed countries with the comparative analysis of the actual situation in our country, National fiscal expenditure environmental public welfare litigation costs and the establishment of public funds to improve environmental public interest litigation system, give full play to the role of environmental public interest litigation system, protect the blue sky.
