香港现行的法律,不论是从形式还是内容来看,都具有殖民地的鲜明特征。从形式上看,香港法律从属于普通法系,其法律渊源不仅包括成文的法律,也有不成文的普通法、衡平法与习惯法。在香港适用的成文法中,不仅包括香港立法局制定的法例及香港有关部门根据法例制定的规则、细则等附属立法,而且还包括英国议会和枢密院制定的适用于香港的英国法律。此外,一部分国际条约和国际协定也由于英国的参加而在港适用。
The current laws in Hong Kong, both in terms of form and content, have distinctive characteristics of colonies. Formally, Hong Kong law is subordinate to the common law system. Its legal sources include not only written law but also unwritten common law, equity and customary law. The applicable statute law in Hong Kong includes not only the legislation enacted by the Legislative Council of Hong Kong but also the subsidiary legislation such as the rules and regulations made by the relevant departments of Hong Kong under the law. It also includes the English law applicable to Hong Kong made by the British Parliament and the Privy Council. In addition, some international treaties and international agreements are also applicable in Hong Kong due to the participation of the United Kingdom.
