2015年3月,全国人大通过了对《立法法》的修改,地方立法权已扩大到全国284个设区市。但从目前情况来看,地方立法权还未用足。除北京外,全国仅有陕西省、江苏省、安徽省、上海市和天津市制定并施行了大气污染防治的地方性法规。地方立法权的扩大充分体现了我国民主法制建设的不断健全和完善,如何在用足地方立法权的同时,制定出公众期待度较高又务实管用的地方性环保法规,值得关注和思考。地方立法要满足这种期待,“务实管用”需把握好
In March 2015, the National People’s Congress passed the revision of the “Legislation Law”, and the local legislative power has been extended to 284 districts and cities nationwide. However, from the current situation, the local legislative power has not yet reached its full capacity. Except for Beijing, only Shaanxi Province, Jiangsu Province, Anhui Province, Shanghai Municipality and Tianjin Municipality have formulated and implemented local laws and regulations on prevention and control of air pollution. The expansion of local legislative power fully reflects the continuous improvement and perfection of the construction of democratic legal system in our country. It is worth attention and reflection on how to formulate the local environmental protection laws and regulations with high expectation and pragmatism while enacting the legislative power in sufficient places.
