物业管理发展的一个重要核心问题就是关于业主委员会的法律定位问题,本文主要分析了业主委员会的主体地位,认为其不是法人组织,而应当将其纳入非法人组织。在实践中,应由业主委员会进行起诉和应诉,并由全体业主共同承担诉讼结果。明确业主委员会的法律地位,是我国建立业主自治与物业管理专业化相结合的管理体制的基础,也是规范物业管理的前提和必然要求。
An important core issue in the development of property management is the legal positioning of the owners ’committee. This article mainly analyzes the dominant position of the owners’ committee and considers that it is not a legal person organization, but should be included in the non-legal person organization. In practice, the owners’ committees should prosecute and respond to the litigation, and all the owners jointly assume the result of the litigation. To clarify the legal status of the owners’ committees is the basis for our country to establish a management system that integrates the ownership of owners and the professionalization of property management. It also serves as a prerequisite and an inevitable requirement for regulating property management.
