引论“法律必须被信仰,否则它将形同虚设。”———伯尔曼《法律与宗教》美国法学家哈罗德·伯尔曼在其作品《法律与宗教》中提出这一如今广为人所知的论断。生于1918年,逝于2007年的伯尔曼,在其一生中,经历了对于全人类意义非凡的20世纪。伴随着世界大战、美苏冷战、屠杀与革命、殖民地复权、原子弹的出现、科技的高速发展,人类追求自由平等的意识在世界范围内激进。经过复杂的政治角力、思想变迁与制度更替,一个重要的问题浮现:人类生存的意义出现了危机。
Introduction “Law must be faith, or it will be null and void.” --- Berman “Law and Religion” American jurist Harold Berman proposed this in his book “Law and Religion” Widely known assertion. Born in 1918 and died in 2007, Berman during his lifetime has undergone a twentieth century of extraordinary significance for all humanity. With the World War, the Cold War between the United States and the Soviet Union, the massacre and revolution, the restoration of colonies, the appearance of atomic bombs, the rapid development of science and technology, and the human consciousness of pursuing freedom and equality have become radical in the world. After complicated political wrestles, changes in thinking and institutional changes, an important issue emerged: the crisis of the significance of human existence.
