交通部《公路经营权有偿转让管理办法》（《办法》）指出：公路经营权包括公路线路的收费权和公路沿线附属设施的经营权。但《公路法脚没有出现公路经营权的概念，而只提及公路收费权及其转让。究其原因，经营权按照经济学上的名词解释，应该包括占有、使用、收益和依法处置权
