在大陆法系国家,对于预备与未遂的界限有两种立法模式。通过对两种立法模式下预备与未遂界限的理论阐释进行分析比较,可以得出应以“行为人为实现犯罪的决意而实施对刑法分则的具体犯罪构成要件所保护的法益具有迫切危险的行为”作为预备与未遂的界限。在预备与未遂界限问题上,中国应选择德国和意大利的立法模式,司法适用中,应建构刑事判例制度。
