凉山彝族本土司法体系完备,至今仍在当地彝族民众的心目中具有根深蒂固的存在空间和坚实基础,同样也在当地社会的秩序规范运行中有效地发挥着难以替代的司法功能。不少彝族民众,特别是乡村彝族民众对本土法律的熟悉、认知和依赖程度事实上远远超过国家法。通过对彝族本土司法人员职业分工的纵向特点,本土司法执行环境与现状,本土司法执行主体与特征三个议题作一次尝试性解读,我们可以发掘出性别权益保障的另一种背景与意义。
The well-established judicial system of the Liangshan Yi people still has a deep-rooted existence and a solid foundation in the local Yi people. It also effectively plays an irreplaceable judicial function in the normative operation of local society. Many Yi people, especially the rural Yi people, are familiar, cognizant and dependent on local laws far more than national laws. Through an attempt to interpret the three aspects of the vertical division of labor of the Yi nationality judicial personnel, the environment and the status quo of the local judicial administration, the subjects and features of the local judicial administration, we can find out another background and significance of the protection of the rights and interests of the sexes.
