以WTO为代表的多边贸易规则和以自由贸易协定(FTA)为代表的“多-双边”贸易规则构成了规制国有企业的国际贸易法制框架。国际贸易法为国有企业提供了国际层面上的规制纪律,要求国有企业在商业考虑基础上从事商业行为,不得从事反竞争行为或滥用市场支配地位;自由贸易协定缔约国应遵守“竞争中立”等原则,促进国企与私企之间的贸易、投资和竞争机会平等。国际贸易法框架下的国有企业规制纪律可以为我国国企改革和贸易协定谈判提供借鉴。
The multilateral trade rules represented by the WTO and the “multi-bilateral” trade rules represented by the Free Trade Agreement (FTA) constitute the legal framework for the international trade governing state-owned enterprises. International Trade Law provides state-owned enterprises with regulatory disciplines at the international level, requires state-owned enterprises to engage in commercial activities on the basis of commercial considerations, shall not engage in anti-competitive conduct or abuse their dominant market position; and parties to free trade agreements shall comply with the principle of “competition neutrality” And other principles to promote the state-owned enterprises and private enterprises in trade, investment and competition equal opportunities. The regulation of state-owned enterprises under the framework of international trade law can provide reference for the reform of China’s state-owned enterprises and the negotiation of trade agreements.
