过度医疗问题不仅仅是一个法律问题,更是一个复杂的社会问题,引起了社会各界的普遍关注。《侵权责任法》第63条规定:“医疗机构及其医务人员不得违反诊疗规范实施不必要的检查”。在此之前,医疗机构不得实施过度医疗行为只是伦理范畴的义务,《侵权责任法》的规定使得该义务成为医疗机构及其医务人员的法定义务,更有利于患者权利的保护。但是,不必要的检查如何界定,实施了不必要的检查是否必然构成侵权,侵害了患者的什么权利以及如何赔偿的问题,法律都没有加以明确,需要进一步研究。
Excessive medical problems are not only a legal issue, but also a complicated social issue that has aroused the widespread concern of all sectors of society. Article 63 of the Tort Liability Act stipulates: “Medical institutions and their medical personnel shall not violate the norms of diagnosis and treatment to carry out unnecessary inspections.” Prior to this, medical institutions must not impose excessive medical practices on ethical issues only. The provisions of Tort Liability Act make this obligation a statutory obligation of medical institutions and their medical staffs, which is more conducive to the protection of patients’ rights. However, how to define the unnecessary inspection, whether the unnecessary inspection must constitute infringement, infringe upon the patient’s rights and how to compensate, the law is not clear and needs further study.
