依据新修订的民诉法,检察机关可以就环境污染事件依法提起公益诉讼。实践中,环境公益诉讼遭遇重重障碍,步履维艰。在我国,针对检察机关是否有权提起环境公益诉讼,学界从法学价值的角度,进行了深入的研究,但是,大多研究仅仅停留在公平、正义价值的层面,公平正义抽象虚化,缺乏具体操作性,笔者尝试从法经济学的角度入手,围绕着检察机关作为环境公益诉讼起诉主体的成本和效率问题以及对社会效果的影响进行一一论证,指出检察机关依法对环境污染事件提起公益诉讼更具优越性,能有效保障环境公益。
According to the newly amended Civil Procedure Law, prosecutors may initiate public interest litigation in accordance with the law on environmental pollution incidents. In practice, environmental public interest litigation has encountered numerous obstacles, struggling. In our country, in view of whether the procuratorial organs have the right to bring environmental public interest litigation, the academic circles conducted in-depth studies from the perspective of legal value.
