近期,全国各地出现很多开发商以售后包租形式拆零销售未竣工商品房屋的情况。这种房屋销售模式引发了两个重要的法律问题:一是开发商与房产承租人之间所签署的房屋租赁合同之有效性问题;二是房屋租赁合同签订以后,如果开发商以售后包租形式将该房产转让给不特定主体,承租人是否有权解除租赁合同。本文将以一起真实案例为研究出发点,对上述两大问题进行深入探讨和分析。
Recently, many developers across the country appear in the form of sale and lease charter sales of uncompleted commodity housing situation.
