电视购物具有不同于传统零售业态的特征,作为新型零售业需要专门法律规制。目前,关于电视购物监管法律制度的讨论多集中在具体制度规范层面,而制度设计者在进行立法时首要考虑的监管目标、原则和体制等一般性规范问题涉及很少。建立和维护有效的电视购物市场秩序的监管目标,保护消费者权益的监管原则以及“确权”和“控权”合理的监管体制是电视购物监管法律制度存在的基础。
Unlike traditional retail formats, TV shopping requires special legal regulation as a new retail industry. At present, the discussion on the legal system of television shopping supervision mostly focuses on the specific system normative level, and the regulatory issues, principles and systems that institutional designers mainly consider in the legislation are rarely involved in the general normative issues. It is the existence of the legal system of television shopping supervision that the regulatory objectives of establishing and maintaining an effective TV shopping market order, the regulatory principle of protecting the rights and interests of consumers, and the sound regulatory regime of “ownership” and “control”.
