《行政诉讼法》规定,人民法院审理行政案件,对行政行为是否合法进行审查。这是《行政诉讼法》的一个重要原则。人民法院对行政案件从哪些方面开展审查呢?主要是:第一,主要证据是否充分。行政机关作出任何影响相对人权利和义务的行政行为,都必须有充分的事实根据。所谓充分的事实根据是指:(1)任何一个行政行为必须有法律规定的事实事件为基础;(2)每一个事实要件必须有相应的事实佐证;(3)每一个事实佐证必须经得起法院的审查,经得起原告的反驳和质证。在行政案件审判中,常见的事实不清、证据不足的表现是:对当事人的陈述不作认真地核实;只听一方意见,不听另一方的意见:只有行政执法人员的记录,没有旁证,等等.
