随着社会经济的发展,行政执法所涉及的内容越来越广泛,其背后所依赖的强制权力的特性也越来越凸显。滥用权力、暴力执法现象正逐渐成为社会关注的焦点,并为法学界所关注。然而,目前关于行政执法责任制度的研究,更多地是从行政执法制度本身的完善和责任追究方面来探讨,忽略了行政的目的及其在法治框架中的地位和角色。通过分析我国法治框架的依据及其目的,探讨了行政机关在法治框架中的使命,提出建立在公共利益考量基础之上的行政执法责任制度,以期为完善行政执法责任制度提供理论参考。
