【裁判要点】工期问题中双方互有违约行为的,在难以区分业主和建筑企业各自应当承担工期延误违约责任大小和因此遭受损失数额的情况下,如业主不能证明自己无违约行为、工程逾期未交工与其无关的情形下,法院不支付业主主张工期逾期违约金的请求。【案情简介】上诉人:新广厦公司被上诉人:二十二冶公司2008年4月17日,新广厦公司作为发包人、二十二冶公司作为承包人签订《建设工程施工合同》,由二十二冶公司承建新广厦公司开发的盘锦广厦新城项目B区工程。开工日期2008年4月20日,竣工日期2008年11月15日。
