文章在现行法律法规框架下,立足审判实践,对离婚案件中涉及按揭的若干疑难问题进行探析。离婚案件中对按揭财产进行实体处理并无法律障碍,但需要注意区分离婚时是否取得房屋产权证的不同处理方式;诉争按财产的定性,应以婚后所得共同制为基础,以首付款的定性作为解决按揭房屋权属关键;按揭房屋的具体分割上,根据不同情形确定不同的补偿方式;离婚案件中变更按揭房屋产权人无须征得银行同意。
