株式会社万代是日本最主要的玩具供应商,其生产的“三国人物”、“高达机动战士”系列拼装玩具在业界享有盛誉。2009年,株式会社万代以我国“TT”高达玩具系列侵犯其著作权为由,将“TT”高达生产商和销售商告上法庭。据了解,被控侵权产品销售范围波及深圳、广州、北京三地,日本株式会社万代索赔金额高达360余万元。近日,这起涉及“高达”等拼装玩具在内的41起系列知识产权案在京审结。因为案情复杂、审理历时1年多,该案入选2010年北京市法院知识产权十大典型案件。今年4月26日是第十一个世界知识产权日,本刊选登此案,回顾事件的来龙去脉,以飨读者。
Bandai Co., Ltd., Japan’s leading supplier of toys, is renowned for its “Three Kingdoms” and “Gundam” series of assembled toys. In 2009, Bandai Co., Ltd. brought “TT ” manufacturers and distributors up to the court on the grounds that our “TT ” toy series violated its copyright. It is understood that the scope of sales of alleged infringement products spread to Shenzhen, Guangzhou and Beijing, Japan Bandai claims up to 360 million. Recently, the series of 41 intellectual property cases involving assembly toys such as “Gundam” were concluded in Beijing.
