《人民司法》今年第7期“案例研究”栏刊登了刘增愉同志的《善意有偿取得财产的第三人的合法权益应受保护》一文(以下简称《刘文》),认为“被告越权出卖代管房屋,买卖关系无效。但第三人购买房屋属于善意有偿取得,对第三人的合法权益亦应维护。因此应判决新建房屋第三人所有,由被告对擅自出卖代管房屋而给原告造成的损失予以赔偿。”对此,笔者有不同看法。
