广告是消费者了解该产品的重要途径之一,特别是邀请公众所熟悉的人为其产品作广告作代言,其影响力及作用是其他广告所远不能及的,这也使得虚假的名人广告的危害性比一般的广告更广更严重。纵观我国立法,对个体代言上的规定是有瑕疵的,使对该类问题的追究处于空白状态,法律的缺失是其产生的根本原因。本文通过对名人虚假广告法律问题的探究,试图寻找出切合实际的解决方案。
Advertising is one of the important ways consumers understand the product. In particular, inviting people who are familiar with the company to advertise their products for endorsement has an influence and effect that is far beyond the reach of other advertisements. This also makes the advertisement of a fake celebrity More harmful than the average general advertising more serious. Throughout our country’s legislation, the provisions on individual endorsements are flawed, leaving the prosecution of such issues in a blank state, and the absence of law is the root cause of the lawsuit. This article attempts to find a realistic solution through the exploration of the legal issues of celebrity false advertising.
