2009年9月18日,由社科院法学研究室主任常纪文牵头,国内多位权威法学专家和NGO组织负责人宫广通参与完成的我国首部专家建议稿在京发布,并向国内外公开征求完善意见.一时间,围绕该意见稿,褒贬不一,国内诸多学者认为"太过超前"、"不具可操作性";而国际动物保护权威则认为"太过保守"、"保护力度不够".本文借此次动物保护立法契机,以"动物权利"为讨论核心,结合中西方学界各派观点,并寻求我国动物保护应有的路径做一初步研究.
