如果稍加留心我们不难发现:近几年来,建设部有关建筑节能方面的管理办法、标准规范、技术规定不断颁布,发展节能省地型住宅和公共建筑的文件着实不少,却没有真正落到实处。在人们看来,节能与否并没有多大区别:一些建筑节能的拥护者没有看到激励措施和享受优惠政策;一些违反建筑节能强制性标准的行为、有节能标准不执行者,也没有受到追究。所以,尴尬的现象依旧上演:一边是能源日益紧缺,一边是建筑能耗继续严重。究其原因,主要是由于和建筑节能相关的这些文件并不具有法律效力,成为了一纸空文。据说,此次建设部起草并向社会公开征求意见的《建筑节能管理条例》,是根据国务院2006年立法计划的要求,首次专门针对民用建筑节能进行公开立法。这预示着一套强硬的法律法规即将出台,建筑节能从此将有法可依,建筑节能工作也将走上法制化的轨道,并依法推进。
