依据《工业产品生产许可证管理条例》及其实施办法等法律法规规定,工业产品生产许可获证企业应当保证产品质量稳定合格,不得降低取得生产许可证的条件。在生产许可证有效期内,企业生产条件、检验手段、生产技术或者工艺发生较大变化的,企业应当及时提出申请,由审查机构或者省级许可证办公室按照实施细则的规定重新组织实地核查和产品检验。这些规定比较明确提出了获证企业的法律义务,然而在违反此种义务后如何承担法律责任方面,却有着不同的理解。本文试结合实际案例,分析监管部门应当如何处理获证企业未依照上述规定申请重新审
According to “Regulations for the Administration of Production License for Industrial Products” and other laws and regulations such as the Measures for the Implementation of the Regulations, the enterprises certified for the production of industrial products shall ensure the stable and qualified products and shall not reduce the conditions for obtaining production licenses. Within the valid period of the production license, if the conditions for production, means of inspection, production technology or process of the enterprise have undergone major changes, the enterprise shall promptly file an application and the reviewing agency or the provincial license office shall reorganize the field verification and the products according to the provisions of the implementation rules test. These provisions more clearly put forward the legal obligations of the certified enterprises, but in violation of such obligations how to assume legal responsibility, but have different understandings. This article tries to combine with the actual case to analyze how the supervisory department should handle the case that the certified enterprise did not apply for re-trial in accordance with the above provisions
