作为一项基本权利,适足食物权是指人人都有获得适足、安全且营养的食物,从而过有尊严的生活的权利。现代食品生产和分配体系过程中存在的不公平,使得该权利在实现的过程中遇到了诸多困难。为了强化适足食物权的落实,又产生了一些与“食”相关的新概念,包括粮食安全、食品安全、粮食主权、食品民主和粮食例外等。本文就从适足食物权这一视角,通过分析上述的概念进而论述它们在相关法律中的法制化进程。
As a fundamental right, the right to adequate food is the right of everyone to have adequate, safe and nutritious food and to live a life of dignity. The unfairness existing in the modern food production and distribution system has caused many difficulties in the realization of this right. In order to strengthen the implementation of the right to adequate food, some new concepts related to “food” have also emerged, including food security, food security, food sovereignty, food democracy and food exceptions. In this paper, from the perspective of the right to adequate food, we analyze the above concepts and further discuss their legalization process in relevant laws.
