2011年1月13日,法国官方公报公布了第2011-48号仲裁改革法令,同时附有评述报告。这是法国30年来第一次对包含于《法国民事诉讼法典》中的1981年仲裁立法作出全面修订。法国这次仲裁法修订既涉及国内仲裁也涉及国际仲裁,新规定包含在《法国民事诉讼法典》第1442条至第1527条中。除个别条款外,新法将在2011年5月1日生效。法国仲裁业界已经为修订法国仲裁法游说良久,这次修订遵循了法国一贯的对仲裁友好并勇于创新的传统。新法的目的是维护巴黎在国际仲裁界的领先地位。官方评述报告阐述道:“三十年后,这次改革有必要将仲裁领域的案例法整合起来,也有必要对现有的条文进行补充以保持其功效。”报告也特别提到,新法“引入了外国法中已经被证明有用的一些规定”。此次仲裁法改革,极大地增强了外国仲裁使用者和观察家对法国仲裁法的知晓便利度。译者根据法国知名仲裁法专家Emmanuel Gaillard先生的英文本,将该法全文译出,同时择要注释说明了新法较旧法的变化。
On January 13, 2011, the Official Gazette of the French issued Decree No. 2011-48 on Arbitration Reform, accompanied by a commentary. This is the first time in 30 years that France has fully revised the 1981 arbitration legislation contained in the French Code of Civil Procedure. The French revision of the Arbitration Law involves both domestic arbitration and international arbitration. The new Provisions are contained in Articles 1442 to 1527 of the French Code of Civil Procedure. With the exception of individual clauses, the new law will come into force on May 1, 2011. The French arbitration industry has been lobbying for amending the French Arbitration Law for a long time. This amendment follows the consistent tradition of France that is friendly and innovative to arbitration. The purpose of the new law is to safeguard Paris’s leading position in international arbitration. The official commentary states: “Thirty years from now, it is necessary for this reform to integrate the case law in the field of arbitration and it is necessary to complement the existing provisions in order to maintain their effectiveness.” “The report also mentions that the new law ”Some provisions that have proven useful in foreign law are introduced ". This reform of the Arbitration Law has greatly enhanced the accessibility of foreign arbitration users and observers to the French Arbitration Law. The translator translated the full text of the law according to the English version of Emmanuel Gaillard, a well-known expert on arbitration law in France. At the same time, the translator explained the changes of the new law over the old law.
