我国知名商品特有包装装潢的法律保护呈现以下特点:一是初步形成以反不正当竞争法及相关司法解释为主,专利法、著作权法、商标法保护为辅的保护体系;二是保护的不确定性,包括知名商品包装装潢本身、不正当竞争认定的不确定性。2016年《反不正当竞争法(修订草案送审稿)》对原第五条涉及知名商品包装装潢的条文做出重大调整,在维持原有保护内容基础上,将商品包装装潢列入商业标志范围之内,并对市场混淆作出进一步规定。文章认为对于我国知名商品包装装潢保护而言,在优化立法规定的同时,仍面临一些问题,如知名商品包装装潢的认定、保护标准的统一等,强调应通过知名商品包装装潢的不正当竞争的认定达到法律保护的目的。
