我国的国有土地纠纷主要分为围绕土地使用权出让形成的民事纠纷、行政纠纷和围绕土地使用权征收形成的行政纠纷。现行的土地权属争议行政调处、民事诉讼、商事仲裁和行政诉讼等纠纷解决机制彼此重复或割裂,降低了国有土地纠纷解决的效率。在市场经济制度不断深化的社会背景下,可考虑淡化并逐步取消行政调处机制在国有土地纠纷中的适用,确立国有土地使用权合同的民事性质,同时将征地补偿协议纳入民事协议范畴,发挥民事诉讼,特别是仲裁在解决国有土地民事争议中的作用,同时规范行政机关配合调查的义务。
China’s state-owned land disputes are mainly divided into civil disputes around the transfer of land use rights, administrative disputes and administrative disputes surrounding the formation of land-use rights. The existing dispute over land ownership disputes and administrative mediation, civil litigation, commercial arbitration and administrative litigation dispute settlement mechanism repeated or fragmented each other, reducing the efficiency of state-owned land dispute resolution. With the deepening market economy system, we can consider to dilute and gradually cancel the application of administrative mediation mechanism in disputes over state-owned land, establish the civil nature of state-owned land use right contracts, at the same time, incorporate land acquisition compensation agreements into the scope of civil agreements and give play to civil Litigation, especially the role of arbitration in settling civil disputes in state-owned land, at the same time standardizes the administrative agencies’ obligations to cooperate with investigations.
