苏先生咨询:我于两年前入职某公司工作,与公司签订了为期3年的劳动合同。去年11月份,我向公司递交了辞职报告,并于年底离开了公司。我已经于今年2月份到新的工作单位就职,前些日子,我到公司办理档案转移手续,公司却以合同期未满为由,拒绝为我办理档案转移手续。请问:公司可以此为由扣留我的档案吗?律师答复:职工档案是企业劳动、人事部门在招用、调配、培训、考核、奖惩和任用等工作中形成的有关职工个人经历、政治思想、业务技术水平、工作表现以及工作变动等情况的文件材料,是历史地、全面地考察职工的依据。
