近年来,欧洲法院对于平行进口商品被重新包装或重新标识的判例,反映了知识产权保护与欧盟内部市场的货物自由流动存在的利益冲突。为合理有效地解决该矛盾,欧洲法院在具体案件中对二者的利益权衡与取舍也不断发生着变化。本文通过阐述欧盟法院的判例及依据,分析和讨论市场一体化与商标保护的冲突,试图展现欧洲法院对此问题的新态度和新立场。
In recent years, the European Court of Justice’s jurisprudence on the repackaging or re-marking of parallel imports reflects a conflict of interest between the protection of intellectual property and the free movement of goods within the EU’s internal market. In order to solve this contradiction reasonably and effectively, the European Court of Justice has constantly changed the trade-offs and trade-offs between the two in specific cases. This article attempts to demonstrate the new attitude and new position of the European Court of Justice on this issue by elaborating the jurisprudence and basis of the EU Court, analyzing and discussing the conflict between market integration and trademark protection.
