企业拥有制定内部劳动规章制度的权利,但如果企业不依据法律规定的内容和程序制定,该劳动规章制度就会失去法律效力,存在严重的法律风险。本文结合《劳动合同法》的有关规定,从企业制定规章制度的一般程序、特别注意事项、合理有效等几方面提出了方法与建议,为企业提供参考。总之,只有合法有效并且严格执行的企业劳动规章制度,才能强有力地支撑企业发展,有效防范企业劳动用工法律风险。
An enterprise has the right to formulate internal labor rules and regulations. However, if an enterprise does not formulate its content and procedures in accordance with the law, the labor rules and regulations will lose its legal validity and there are serious legal risks. This article combines the “Labor Contract Law” with the relevant provisions, from the company’s general rules and procedures for the development of rules and regulations, special attention to matters, reasonable and effective, and other aspects put forward methods and recommendations for enterprises to provide reference. In short, only legal and effective and strictly enforced enterprise labor rules and regulations can strongly support the development of enterprises and effectively prevent legal risk of labor employment.
