自改革开放来,中国经济迅速发展,但快速发展的同时,食品安全问题接二连三地出现,影响越来越严重,给群众带来很大的危害。因此,食品安全问题受到了社会的关注,同时也是我国当前必须要解决的问题。近年来,司法实践的不断发展,很多问题逐渐显露,现行法律已经无法对这些食品安全犯罪问题进行有效的打击。刑法是全部法律的坚强后盾,应该为食品安全问题打下一道防线。如今,我国刑法领域对食品安全犯罪的研究不够深入,并没有对其进行全面的研究与分析。加强对食品安全的保障,不仅可以对食品安全犯罪进行有效的预防与打击,还可以最大程度保障人民群众的生命安全,保障社会经济科学发展。本文以食品安全相关概念作为切入点,通过对现行食品安全法律规制体系分析,结合食品安全现状,分析食品安全产生的因素,并提出若干食品安全完善建议。
Since the reform and opening up, China’s economy has developed rapidly. However, with the rapid development, food safety problems have emerged in succession one after another, with more and more serious implications for the people. Therefore, the issue of food safety has drawn the attention of the society and it is also the problem that must be solved in our country at present. In recent years, the continuous development of judicial practice, many problems gradually revealed, the current law has been unable to effectively crack down on these food safety crimes. Criminal law is the strong backing of all laws and should lay a line of defense for food safety issues. Nowadays, the research on food safety crime in the field of criminal law in our country is not deep enough and has not been fully studied and analyzed. Strengthening the protection of food safety can not only effectively prevent and combat food safety crimes, but also ensure the safety of people’s lives to the maximum extent and ensure the social, economic and scientific development. In this paper, the concept of food safety as a starting point, through the analysis of the current legal system of food safety regulations, combined with the status quo of food safety, analysis of food safety factors, and put forward some recommendations for food safety improvement.
