案例回放本刊2007年第1期刊登案例反映.2005年10月,张某应聘到某食品公司设在一家超市的销售专柜做促销工作,未参加工伤保险。该超市规定,促销员与超市营业员一样进行管理,应遵守超市的上下班时间及其他劳动纪律,工资构成为底薪加提成,由超市代食品公司发放。2006年8月15日,在超市租赁柜台从事经营的赵某与另一经营户郑某由于生意上的原因发生争执,进而发生斗殴。张某上前劝阻,被赵某用刀子砍伤。超市报警后,将张某送医院治疗。张某共花去医疗费用6000余元,赵某仅支付2000元。经鉴定,张某为轻伤。张某要求超市支付其余医疗费、营养费、护理费、误工费等支出,或按工伤处理。超市认为其不是超市员工,而是食品公司的促销员,用人单位应为食品公司而非超市。因而出现了张某能否认定工伤及其损失应如何获得赔偿的问题。
