本文首先简单介绍了恢复性司法内涵,然后从我国被害人的法定权利和权利的现状的分析中认识到被害人权利保护的缺陷,从而说明恢复性司法在促进被害人权利保护方面确实有现实的效用,但也要考虑到恢复性司法的可行性,不能盲目适用。
This article first briefly introduces the connotation of restorative justice, and then from the analysis of the legal rights and rights of victims in our country to recognize the shortcomings of the protection of victims ’rights, which shows that restorative justice does have practical effect in promoting the protection of victims’ rights.
