在环境法治视野之中,我国公安机关基于法律的明确规定担负着一定环保执法的职责。警察权在环境与资源保护中的介入具有其正当性。尽管实践中存在着一些问题,但我国公安机关涉及环境执法已有经验可循。世界许多国家为应对经济发展中严重的环境污染与破坏,纷纷建立了本国的环境警察制度。一个国家环境警察制度的建立是该国全社会环境保护意识发展到一定水平的必然结果。在我国尽快建立起环境警察制度对于有效控制环境风险、保障民生、解决环境执法软弱等均有重要意义,同时它也是警察执法规范化与警务创新的体现。我国环境警察制度的建立具有可行性,同时也须克服一定的障碍。 In the visual field of environmental law, the public security organs of our country bear certain responsibilities of environmental law enforcement based on the explicit stipulations of laws. The right of police to intervene in the protection of environment and resources is justified. Although there are some problems in practice, the public security organs in our country have experience in environmental law enforcement. In response to the serious environmental pollution and destruction in economic development, many countries in the world have successively set up their own environmental police systems. The establishment of a national environmental police system is the inevitable result of the development of a nationwide awareness of environmental protection to a certain level. Establishing an environment police system as soon as possible in our country is of great significance for effectively controlling environmental risks, protecting people’s livelihood and solving the weaknesses in environmental law enforcement. At the same time, it is also a manifestation of the standardization of police enforcement and police innovation. The establishment of the environment police system in our country is feasible. At the same time, some obstacles must be overcome.
