网络言论自由是指公民借助互联网工具以各种形式传递和获取信息和思想的权利,相较之言论自由有着更为特殊的匿名性、任意性和互动性的性质。网络言论自由在被实现的过程中呈现着积极和消极两方面影响,当其不受限制的情况下有侵害个人和公共利益的潜在危险性,而密尔在《论自由》中表达的有关自由限度的“伤害原则”则可以成为限制网络言论自由的一种依据和路径。本文即基于密尔的“伤害原则”对网络言论自由的特性和限制进行相关的解析。
Freedom of expression in the internet refers to citizens’ right to transmit and acquire information and ideas in various forms through Internet tools. Compared with the freedom of speech, the citizens have a more special nature of anonymity, arbitrariness and interactivity. The freedom of speech in the network has both positive and negative effects in the course of its realization. When it is unrestricted, there is the potential danger of infringement of personal and public interests. The freedom that Mill expressed in “On Freedom” Limitation “Injury Principle ” can become a kind of basis and path to restrict the freedom of speech in the internet. This article is based on Mill’s “Principles of Injury” to analyze the characteristics and limitations of online freedom of speech.
