2008年国际金融危机消退后,许多国家和地区纷纷以“消费者保护”为导向进行金融监管体制的重构,金融消费者保护在金融体系长期稳定中的重要性日益凸显。尽管我国证券行业建立了较为完善的“投资者保护”体系,但对于“金融消费者保护”的理念仍然较为陌生。本文在简要辨析“金融消费者”与“投资者”概念的基础上,阐述证券行业开展金融消费者保护的必要性,并结合我国证券行业投资者保护的现状,提出在证券行业全面引入“金融消费者保护”理念,建立健全金融消费者保护的基本法律制度,以及对证券行业金融消费者进行倾斜性保护等建议。
After the international financial crisis receded in 2008, many countries and regions have reorganized the financial regulatory system with “consumer protection” as the guide. The importance of financial consumer protection in the long-term stability of the financial system has become increasingly prominent. Although China’s securities industry has established a relatively perfect “investor protection system,” the concept of “financial consumer protection” is still relatively unfamiliar. Based on the brief analysis of the concept of “financial consumer” and “investor”, this paper expounds the necessity of carrying out financial consumer protection in the securities industry. Combined with the status quo of investor protection in the securities industry in our country, We will fully introduce the concept of “financial consumer protection”, establish and improve the basic legal system for the protection of financial consumers, and provide suggestions for the tilt protection of financial consumers in the securities industry.
