行政指导行为是指我国在行政管理领域,在民主化的行政进程中被经常提到的一种政府管理模式。近些年来,我国政府逐渐由管理型转变成服务型,结合当今社会实际情况,正确定位行政指导行为,将行政指导行为纳入司法审查范围,使得政府在进行职能管理、行政服务的过程中有法可依、有规可循是一个艰巨的问题。本文从行政指导行为的一般性出发,讨论了主张行政指导行为不可诉的原因,并从理论和实践上分析了行政指导行为可诉性的依据,对行政指导的可诉性进行了重新认识,希望对完善我国行政指导的司法救济制度有所帮助。
