独立宣告是一种割裂主权隶属关系,塑造崭新国际法主权体的极端实践,也是一件关乎地缘政治,乃至整个国际社会之利益的大事。在国际法中,新国家可以通过独立、分离、分立与合并产生,而其中前三者都与独立宣告联系密切。一份独立宣告是否能够实现上述目标,关键在于能否获得普遍的国际承认。文章认为,国际承认是独立宣告产生法律效力的必要前提。依据国际实践,国际社会在考虑是否承认一个宣告独立的国际法实体时,首先考虑以下两个标准:第一,该份独立宣告满足合法性要求;第二,该实体有遵守国际法规则的意愿和能力。其次,对独立宣告的国际承认遵循如下三个原则:母国许可原则、顺应国际法精神原则和多元化原则。
Declaration of independence is an extreme practice of severing the subordination of sovereignty and shaping a new body of international law and sovereignty. It is also an event concerning the interests of geopolitics and of the entire international community. In international law, the new countries can be created by independence, separation, separation and merger, and the first three of them are closely linked with the declaration of independence. Whether or not an independent declaration can achieve the above goal depends on whether universal international recognition can be obtained. The article holds that international recognition is the necessary precondition for the independent declaration of legal validity. In accordance with international practice, the international community first considers the following two criteria when considering whether or not to recognize an entity of international law that declares independence: first, the declaration of independence satisfies the requirement of legitimacy; secondly, the entity has the will and ability to comply with the rules of international law . Secondly, the international recognition of independent declaration follows the following three principles: the principle of home country permission, in conformity with the spirit of international law and the principle of pluralism.
