本文旨在通过分析网络侵权归责的两个重要法律规则——“避风港规则”和“红旗规则”的适用条件,来探析新媒体编辑从业人员在编辑实务中的合理注意义务,从实务操作层面来探析新媒体降低网络侵权法律风险的必要措施。
The purpose of this paper is to analyze the reasonable attention duty of the new media editors in editing practice by analyzing the application conditions of the two important legal rules of network infringement - “Safe Harbor Rules” and “Red Flag Rules” Probing into Necessary Measures for New Media to Reduce Legal Risk of Internet Infringement from the Practical Operational Level.
