我国的《反不正当竞争法》规定了擅自使用知名商品的特有的名称,包装,装潢,造成和他人的知名商品相混淆的这种行为是不正当竞争的行为,但是法律没有进一步阐述如何认定知名商品,如何认定特有的名称,包装,装潢。本文结合行政及司法实践案例简述认定的要件和基本原则。
The Anti-Unfair Competition Law of our country stipulates that the unauthorized use of the unique name, packaging and decorating of well-known goods and the confusion with others’ well-known goods are acts of unfair competition. However, the law does not elaborate on how to identify Well-known goods, how to identify the unique name, packaging, decoration. This article combines the essentials and basic principles of the administrative cases and judicial practices.
