近些年由于经济形势带动及产业结构调整餐饮业进入了长足发展阶段,与此而来的也是年均4000万吨左右的餐厨垃圾。在处理技术上国内对于餐厨垃圾资源化处理尚处在起步阶段,处理率仅在10%;在餐厨垃圾管理上法律法规不完善,监管和执行力度也有待提高。故文章拟从分类回收制度、回收收费制度、污染风险防范制度三个方面阐述完善餐厨垃圾治理法律制度的建议,以期我国实现餐厨垃圾资源化、无害化、减量化的目标。
In recent years, due to the economic situation and the adjustment of the industrial structure, the catering industry has entered a phase of rapid development. This is followed by the consumption of 40 million tons of food waste every year. In terms of processing technology, domestic resources for food waste treatment is still in its infancy, the treatment rate of only 10%; in the food waste management laws and regulations imperfect, supervision and implementation efforts have yet to be improved. Therefore, it is proposed to improve the legal system of food waste management from three aspects: the classification recovery system, the recovery charging system and the pollution risk prevention system, in order to achieve the goal of recycling, decontamination and reduction of food waste in our country.
