关于死刑的问题一直以来都在进行激烈的争论,不仅是因为死刑本身的严厉性,更在于死刑问题的时代性与国际性。然而纵观当今对死刑的争论,绝大多数是从一个犯罪人的视角下去进行的探讨,大多得出极力主张废除死刑的结论。犯罪人的视角是不可取的,因为它未能抓住死刑的关键。正因此本文提出一个新的视角即以受害人的视角来对死刑进行审视和探讨,从而得出一些更可取的针对死刑问题的结论和对策。
The issue of death penalty has been heatedly debated not only because of the severity of the death penalty, but also because of the current and international character of the death penalty. However, looking at the current debate over the death penalty, the vast majority of the discussions are conducted from the perspective of an offender. Most of them come to the conclusion that they strongly advocate the abolition of the death penalty. The perpetrator’s perspective is not desirable because it fails to capture the key to the death penalty. Therefore, this article proposes a new perspective that examines and discusses the death penalty from the perspective of the victim so as to draw some conclusions and countermeasures that are more desirable for the death penalty issue.
