不道是秦汉时代的一个特殊罪名。过去法律史学界将其意义等同于无道,几成定论。本文进行了新的诠释。认为这里的不道是省略“不说”的意思。它是对罪犯必须惩办,而罪状却不宜公开,甚至需要刻意掩饰,因此在劾罪、议罪、判罪时不予宣布具体罪行的一类犯罪的定性。指出,不道源于古老的语言禁忌,在中国传统文化中能够寻找到它的发生学原理。其中除了功利得失的计算之外,还可以分辨出其所蕴涵的些许尊重人格的理念、保护隐私的意识,甚至能体会到一丝悲天悯人的情怀。
