商业银行暴露的各类信用风险是各类市场风险的集中反映.L省涉商业银行信用风险犯罪案件持续高发,涉案罪名、地区分布、涉案银行类型、涉案手段较为集中,涉案金额巨大.部分小型农村金融机构风险管控失效;企业融资渠道不畅,导致个别企业铤而走险;银行对于贷款用途的审核管理存在漏洞,内部人员的管理机制存在缺陷;惠农贷款被违法套取,影响惠农政策实施.在案件办理中司法机关对贷款诈骗罪非法占有的目的、骗取贷款罪“重大损失或者有其他严重情节”、银行内部人员犯罪行为的定性存在争议,对于民营企业融资类案件逮捕标准把握尺度过严.检察机关要进一步树立为经济发展大局服务的理念,着力解决司法实践中的争议问题,加大综合治理的力度,促进保护民营经济健康发展.
