玩家的虚拟财产被“盗买”或者“被封”后,该玩家是否可以取回该被盗的虚拟财产?如果可以取回,应当向谁取回?如果不能取回,能否获得赔偿?这些是玩家、网络游戏运营商以及法官在处理虚拟财产交易纠纷时所无法回避的问题。面对这些问题,本文分析了司法实践中《合同法》、《物权法》、《侵权责任法》等法律在解决上述问题时所面临的不同困境,并探讨了虚拟财产物权说、准物权说以及债权说等理论不同解决办法,并认为以现行《合同法》及其特别法《消费者权益保护法》来解决虚拟财产交易纠纷是最为合适的选择。
