住房权是一项基本人权,国家以立法方式确立和保障公民的住房权是解决住房问题的根本途径。鉴于我国现行住房法律制度存在效力层级不合理、基本性法律缺失等问题,使得制定一部专门性综合性法律——《住房法》成为必需。在这一立法进程中,应坚持保障人权、权利义务配置均衡、系统性解决住房问题等原则,就与住房权有关的法律制度作出设计与安排,为根本解决我国住房问题和保障公民的住房权提供法律支撑。
The right to housing is a basic human right. It is the fundamental way for the state to establish and guarantee the housing rights of citizens through legislation. In view of the fact that the existing legal system of housing in our country has such problems as the unreasonable level of effectiveness and the lack of basic laws, it is necessary to formulate a special comprehensive law - the “Housing Law”. In this legislative process, we should insist on the principles of guaranteeing human rights, balancing the configuration of rights and obligations, and systematically solving the housing problems.
