健康是我们一生中最大的财 富,不是有句话这样说吗:“没什么 别没钱,有什么别有病。”形象地说 明了老百姓怕没钱,怕得病,更怕 看病的普遍心理。因为一走进医 院,从挂号开始,这整个人和钱可 就全交给医院了。不怕花钱多少, 就怕钱花了。病没好.甚至搭上自 家性命。尽管有事后的种种赔偿, 可人都没了,钱还有什么用?患者和 医院都不能左右病魔的出现.能做 的只有全力避免噩梦般的结局。 2002年9月1日,《医疗事故 处理条例》正式实施(下简称《条 例》),1987年颁布的《医疗事故处 理办法》随即废止(下简称《办法》)。 转眼两年过去了,在处理医患纠纷 过程中,新《条例》与旧《办法》的区 别在哪里?《条例》又是如何体现人 们的生命健康权,最大限度地减少 医疗事故的发生的立法目的?为了 让广大读者对《奈例》有更进一步 的理解.本文采用以案说法的方式 就一些医疗纠纷案例进行分析与 说明。
