随着互联网应用的类型多样化、复杂化和广泛化,在互联网应用中的消费者权益保护日趋重要。在互联网应用中,消费关系广泛存在,而消费者的身份界定、经营者的义务内容都出现了有别于传统消费者权益保护法法理的新特征。而且中国互联网应用的一大特点是免费模式的应用占主导地位。现有的消费者权益保护制度,对于在免费应用中消费者能否受到保护,能受到何种程度的保护的规定也并不清楚。因此,有必要分析互联网应用中消费关系的具体表现形态,并相应地制定针对互联网消费关系纠纷的法律制度。
With the diversification, complexity and extensiveness of Internet applications, the protection of consumers' rights and interests in Internet applications is becoming more and more important. In the Internet applications, consumer relations exist widely, and consumers define the identity, the contents of the obligations of the operator are different from the traditional consumer rights and interests of the legal protection of new features. And one of the major features of China's internet usage is the dominance of free-mode applications. The existing system of protecting the rights and interests of consumers is not clear about the degree to which consumers can be protected in free applications. Therefore, it is necessary to analyze the concrete manifestations of consumer relations in Internet applications and to formulate a legal system for Internet consumer disputes accordingly.
