随着我国市场经济的不断发展,比较广告等新的广告形式不断涌现出来,新的广告形式导致的纠纷越来越多,现行的广告法律制度已经显得捉襟见肘。文章通过对比我国及欧美等国现有法律对违法比较广告的规制,总结指出我国在违法比较广告法律规制方面存在的法条过于简单化、内容上过于狭窄、缺乏可操作性等缺陷,应从立法、行政监督、司法裁判等方面加以完善。
With the continuous development of the market economy in our country, new forms of advertisements such as comparative advertisements continue to emerge. More and more disputes have been caused by the new forms of advertisements. The current legal system of advertisements has become stretched.
