选拔任用干部作为维系群众与政府之间的委托代理关系,蕴含着丰富政治现实涵义,但是其选任主体却实质以官员、组织为中心和落脚点,在国家、政府构建进程中扮演重要角色的一般民众一直被置于实质“主体”之外。本文基于马歇尔的公民身份理论,对干部选任中民众政治权利的发展历史进行梳理,并分析群众政治权利及其缺失问题,进而探讨相关救济路径。
The selection and appointment of cadres, as the principal-agent relationship between the masses and the government, embodies the meaning of rich political reality. However, the elected cadres are essentially officials and organizations as the center and the foothold, playing an important role in the national and government building process The general public has always been placed outside of the “essence”. Based on Marshall ’s theory of citizenship, this essay sorts out the history of the development of popular political rights during the election of cadres, and analyzes the problems of political rights and their absence, and then explores the related remedies.
